As an attorney who litigates cases, you often are faced with questions both before and after judgment. Should I appeal an unfavorable decision? How do I defend a favorable decision when the other party lost and now appeals? Nothing in this blog substitutes for experienced legal advice directed at your specific situation. California appeals and petitions for writs are complex matters requiring experienced help. Procedural traps abound. An appeal is not simply another opportunity to argue your case. The court of appeal is not merely a “second juror” or a “back-up judge.” Appellate justices generally are in the business of resolving cases in a way that makes sense to the public generally; if you do not present your case to them in a manner that fits their role, you may actually weaken your client’s cause. An appeal is not relitigation of your case. Hopefully this blog will give you a sense of how to handle appeals successfully.
